INTRODUCTION

Switly is a talent network (“Platform”) which helps online communities of software engineers (“Talent”) to connect with hiring and training companies (“Talent Seekers”) in a trustworthy, privacy friendly & discreet manner. As such, we are committed to providing a friendly, safe and welcoming environment for all Talent and Talent Seekers, regardless of gender, sexual orientation, disability, ethnicity, or religion. This code of conduct outlines our expectations for user behavior as well as the consequences for unacceptable behavior. We invite all our “users” (Talent & Talent Seekers) and “partners” to help us realize a safe, positive and privacy friendly experience for everyone.

SCOPE

We expect all “users” and partners to abide by this code of conduct and content policy at all times.

EXPECTED BEHAVIOUR FOR EVERYONE

  • Be considerate, respectful of people and their privacy.
  • Refrain from demeaning, discriminatory, or harassing behavior and speech.
  • Use the site only for lawful purposes
  • Do not reproduce, duplicate copy or re-sell any part of our platform
  • Do not attempt to access our platform without authority, interfere with, damage or disrupt:
    • Any part of our platform
    • Any equipment or network on which our site is stored;
    • Any software used in the provision of our site; or
    • Any equipment or network or software owned or used by any third party.
  • Only upload content that complies with our “Contributions Policy” below

EXPECTED BEHAVIOUR FOR TALENT

  • Conduct yourself in a professional manner at all times
  • Be truthful of your professional experience and qualifications

EXPECTED BEHAVIOUR FOR TALENT SEEKERS

  • Treat Talent data with respect
  • Do not harass or frequently contact Talent without their express permission
  • When access to certain data such as CV’s/Resumes has been revoked, delete all copies of the data in a timely manner

UNACCEPTABLE BEHAVIOUR

  • Intimidating, harassing, abusive, discriminatory, derogatory or demeaning conduct by any user or partner
  • Harassment includes: offensive verbal comments related to gender, sexual orientation, race, religion, disability; inappropriate use of nudity and/or sexual images; deliberate intimidation, stalking or following; harassing photography or recording; and unwelcome sexual attention.
  • Any behaviour that breaches any applicable local, national or international law or regulation.
  • Any behaviour that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
  • To send, knowingly receive, upload, download, use or re-use any material which does not comply with our Content Policy below
  • To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
  • To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

CONTRIBUTIONS POLICY

These standards apply to any and all material which you contribute or upload to our site ("contributions"). All users and partners must comply with the following standards. The standards apply to each part of any contribution as well as to its whole. Contributions must not:
  • infringe any copyright, database right or trade mark of any other person;
  • contain any material which is defamatory of any person;
  • contain any material which is obscene, offensive, hateful or inflammatory;
  • promote sexually explicit material;
  • promote violence;
  • promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
  • be likely to deceive any person;
  • be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
  • promote any illegal activity;
  • be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety;
  • be likely to harass, upset, embarrass, alarm or annoy any other person;
  • be used to impersonate any person, or to misrepresent your identity or affiliation with any person;
  • give the impression that they emanate from us, if this is not the case;
  • advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

CONSEQUENCES OF UNACCEPTABLE BEHAVIOUR

Unacceptable behavior will not be tolerated whether by any user or partner. Anyone asked to stop unacceptable behavior is expected to comply immediately. Switly reserves the right to take any action they deem appropriate, up to and including expulsion from the platform without warning or refund.

WHAT TO DO IF YOU WITNESS OR ARE SUBJECT TO UNACCEPTABLE BEHAVIOUR

If you are subject to unacceptable behavior, notice that someone else is being subject to unacceptable behavior, or have any other concerns, please notify [email protected] as soon as possible. All reports will remain completely confidential.
